TERMS AND CONDITIONS OF SERVICE — VITAM

INTRODUCTION AND ACCEPTANCE

This website, vitamsolution.it (the "Site"), is operated by VITAM, with its registered office at Via Pietro Calanna 10, 95034 Bronte (CT), Italy — a FAAC certified service centre for eastern Sicily.

The terms "VITAM", "we", "us" and "our" on the Site refer to that same entity.

These Terms and Conditions of Service (the "Terms") govern access to and use of the Site, as well as the purchase of the products and services offered on it. By visiting the Site or making a purchase, the user accepts these Terms in full. If you do not accept these conditions in their entirety, you must refrain from using the Site and its services.

These Terms apply to all users of the Site, including visitors, customers, prospective customers and anyone accessing the published content.

The most recent version of these Terms is always available on this page. VITAM reserves the right to update these Terms at any time; continued use of the Site after changes are published constitutes acceptance of them.

The e-commerce platform is hosted by Shopify Inc., which provides VITAM with the technological infrastructure for managing online orders.


SECTION 1 — SUBJECT MATTER AND SCOPE

VITAM operates in the fields of gate automation, home automation, integrated security and solar PV systems, offering through the Site:

  • Physical products: devices, components and accessories for FAAC automation, security systems and solar PV systems, available to buy online with delivery to the address specified by the buyer;
  • Professional services: technical site surveys, installations, configuration, maintenance and support, delivered directly by VITAM's qualified staff at the customer's premises, by prior arrangement.

These Terms apply to both categories, subject to the distinctions set out in the relevant sections.

Use of the Site is permitted solely to natural persons of legal age or to legal entities acting through a duly authorised representative. Anyone making a purchase declares, on their own responsibility, that they meet these requirements.


SECTION 2 — GENERAL CONDITIONS OF USE OF THE SITE

The user undertakes to use the Site and its content solely for lawful purposes, in compliance with applicable Italian and European legislation and with the rights of third parties.

The following are expressly prohibited:

  • reproducing, copying, reselling or commercially exploiting any part of the Site or its content without VITAM's prior written authorisation;
  • transmitting viruses, malicious code or any other element capable of compromising the operation of the Site or the systems connected to it;
  • collecting other users' personal data or carrying out scraping, crawling or unauthorised automated access;
  • using the Site to distribute unlawful, offensive or defamatory content, or content that infringes the rights of others;
  • impersonating others or providing false or misleading information during the purchase or registration process.

VITAM reserves the right to deny access to the Site or to suspend an account in the event of a breach of these conditions, without prior notice.


SECTION 3 — PRODUCTS AND SERVICES

3.1 — Physical products
Physical products available on the Site may be subject to limited availability. VITAM undertakes to keep availability information up to date, but cannot guarantee at all times that the stock levels displayed match actual stock in real time.

Product images are provided for illustrative purposes. Colour reproduction on screen may vary according to the user's device settings.

3.2 — Professional services
Professional services — installation of FAAC automation, home automation systems, solar PV systems, security systems and technical site surveys — are subject to prior technical assessment and scheduling. Purchasing a service online constitutes a request for professional services; the conditions for carrying out the work will be agreed with the customer, including by means of a free site survey bookable at cal.com/vitam/sopralluogo.

For services personalised or tailored to the specific requirements of the installation site, the right of withdrawal is excluded once performance begins, pursuant to Article 59(a) and (c) of Legislative Decree 206/2005, subject to the customer's express consent.

3.3 — Prices and availability
Prices shown on the Site are expressed in Euro, inclusive of VAT where applicable, and may change without notice. VITAM reserves the right to amend prices, product descriptions and item availability at any time. Any price change occurring after order confirmation will not affect orders already placed.

3.4 — Orders and their management
VITAM reserves the right to refuse or cancel an order in the event of incorrect information, product unavailability, irregularities in the payment process or reasonable suspicion of improper use of the Site. In such cases the user will be informed promptly and, where payment has already been taken, will be refunded in full within the time reasonably required.


SECTION 4 — ACCOUNT INFORMATION AND BILLING DETAILS

Users are required to provide accurate, complete and up-to-date information when registering and when making a purchase. In particular, it is the user's responsibility to keep contact details, delivery address and payment information up to date.

VITAM cannot be held liable for disruptions, failed deliveries or delays arising from incorrect, incomplete or out-of-date information provided by the user.


SECTION 5 — ACCURACY OF INFORMATION

VITAM is committed to ensuring that the information on the Site is accurate and up to date. However, the content published is informational in nature and is not a substitute for professional technical advice. For a specific assessment of the automation, home automation or solar PV solutions suited to your situation, we recommend requesting a free site survey or contacting our team directly.

Despite our best efforts, we cannot guarantee that the Site is free from typographical errors, inaccuracies or out-of-date information. VITAM reserves the right to correct any errors and omissions at any time, including after an order has been placed, notifying the customer promptly.


SECTION 6 — RIGHT OF WITHDRAWAL AND RETURNS

The right of withdrawal, the conditions for returns and the arrangements for refunds are set out in full in our Returns and Refunds Policy, published at vitamsolution.it and forming an integral part of these Terms.

In summary, pursuant to Article 52 of Legislative Decree 206/2005 (the Italian Consumer Code):

  • A private consumer has the right to withdraw from the purchase of physical products within 14 days of delivery, without having to give a reason;
  • For professional services begun with the customer's express consent, the right of withdrawal is extinguished on completion of the service;
  • In accordance with Legislative Decree 209/2025 (Article 54-bis of the Italian Consumer Code), a digital withdrawal function is available directly on the Site for contracts concluded online, enabling the consumer to exercise that right by means of an online declaration.

SECTION 7 — LEGAL GUARANTEE OF CONFORMITY

For physical products purchased on vitamsolution.it, private consumers are entitled to the legal guarantee of conformity provided for by Articles 128 et seq. of Legislative Decree 206/2005, for a period of two years from delivery of the goods.

Where a product is found to be defective or not as described, the customer is entitled, in order of preference, to repair or replacement of the goods or — in the cases provided for by law — to a price reduction or termination of the contract.

To report a fault or defect, you must contact VITAM within 2 months of discovering the defect, at info@vitamsolution.it or via the form available at vitamsolution.it/pages/contact, attaching photographic evidence and the order number.


SECTION 8 — DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

VITAM does not warrant that the Site will be accessible without interruption, free from errors or immune to unforeseen technical events. The Site and its content are made available "as is", to the fullest extent permitted by applicable legislation.

Without prejudice to consumer protection legislation — which cannot be contractually varied to the user's detriment — VITAM shall not be held liable for:

  • indirect, incidental or consequential damages arising from use of the Site or from any inability to access it;
  • loss of data or business interruption caused by events outside its reasonable control;
  • the content or conduct of third-party websites that may be reached via links on the Site.

The above limitation applies to the extent permitted by Italian law and by European consumer protection legislation.


SECTION 9 — THIRD-PARTY TOOLS AND SERVICES

The Site may integrate tools, widgets or services provided by third parties (for example payment systems, booking services, communication platforms). VITAM exercises no control over such services and is not responsible for their operation, security or content.

Use of third-party tools accessible from the Site is subject to the terms and conditions of the respective providers, which we recommend you read before use.


SECTION 10 — LINKS TO THIRD-PARTY SITES

The Site may contain links to external websites, provided for reference or further information. VITAM is not responsible for the content, accuracy or commercial practices of third-party sites. The presence of a hyperlink does not imply any form of endorsement or affiliation.


SECTION 11 — INTELLECTUAL PROPERTY

All content on the Site — text, images, logos, graphics, video, names, trade marks and informational material — is the exclusive property of VITAM or licensed to VITAM by the respective owners, and is protected by Italian and European intellectual property legislation.

Any reproduction, distribution, modification or commercial use of the Site's content without VITAM's prior written authorisation is prohibited. Access to the Site does not grant the user any licence or right to use the content published on it, other than for personal, non-commercial reference.


SECTION 12 — USER COMMUNICATIONS AND COMMENTS

Any communication sent to VITAM through the channels indicated on the Site — enquiries, feedback, suggestions — may be used by VITAM to improve its service, in accordance with data protection legislation and with the Privacy Policy.

VITAM assumes no obligation of confidentiality in respect of information that does not qualify as personal data or trade secrets, nor is it required to pay any consideration for ideas, suggestions or proposals submitted voluntarily.


SECTION 13 — PERSONAL DATA AND PRIVACY

The processing of users' personal data is governed by VITAM's Privacy Policy , published on the Site and drawn up in accordance with Regulation (EU) 2016/679 (GDPR) and applicable national legislation.

Users are invited to read the Privacy Policy before providing their personal data through the Site.


SECTION 14 — INDEMNITY

The user agrees to indemnify and hold harmless VITAM, its directors, employees and collaborators against any claim, damage, loss or expense — including reasonable legal costs — arising from the user's breach of these Terms, from improper use of the Site or from the infringement of third-party rights.


SECTION 15 — SEVERABILITY

If one or more provisions of these Terms are found to be unlawful, void or unenforceable under applicable legislation, the provision concerned shall be severed from this document without affecting the validity and effectiveness of the remaining provisions.


SECTION 16 — DURATION AND TERMINATION

These Terms remain in force for as long as the user continues to use the Site. VITAM reserves the right to suspend or terminate access to the Site where a breach of these Terms is established, with immediate effect and without prior notice. Provisions which by their nature are intended to survive termination (warranties, limitations of liability, intellectual property) shall continue to apply thereafter.


SECTION 17 — GOVERNING LAW AND JURISDICTION

These Terms are governed by Italian law. For private consumers resident in the European Union, the mandatory provisions of the law of the consumer's country of residence apply, pursuant to Regulation (EC) No 593/2008 (Rome I).

For disputes with private consumers, the competent court is that of the consumer's place of residence or domicile, in accordance with Article 33(2)(u) of Legislative Decree 206/2005. For disputes with parties not qualifying as consumers, the courts of the following city shall have exclusive jurisdiction: Catania, Italy.

SECTION 18 — CHANGES TO THESE TERMS

VITAM reserves the right to update these Terms at any time by publishing the updated version on this page together with the date of revision. We recommend checking this page periodically. Continued use of the Site after changes are published constitutes acceptance of those changes.
